WOOD-TV in Grand Rapids reports that although a Kent County Circuit Court judge dismissed a lawsuit brought by the Mackinac Center Legal Foundation against 10 school districts over illegal contract language, “Judge James Redford stated in his opinion his ruling is not an approval of the policy” and he is “concerned it was even included in the collective bargaining agreements.”
State law says privatization of noninstructional services is a prohibited subject in collective bargaining for school districts. The MCLF filed the lawsuit on behalf of five Kent County taxpayers, but the judge ruled they did not have standing in the matter.
“It seems that the way the law is written, only a school board or bargaining unit can have standing,” Patrick Wright, director of the MCLF, told The Grand Rapids Press. “So the two groups who are violating the law are the only ones who could enforce it.”
